How to get an Italian marriage certificate from abroad

The marriage record is needed more often than people expect: for a divorce abroad, for a family reunification application, for a survivor’s pension, for an inheritance, to prove a married surname, or for a citizenship application through marriage.

The document is held by the civil status office of the Italian comune (municipality) where the marriage took place — or, if you married abroad, by the Italian comune where the record was transcribed. That office works in Italian, during Italian hours, and in many cases has no online service accessible from abroad.

The consulate can issue some documents, but only for people registered with AIRE in that district, and appointment waiting times in Latin America often exceed a year.

Where the record is held if you married abroad

This is the question we are asked most often, and it is also the most common reason why requests fail.

If you married abroad and the marriage was transcribed in Italy, the Italian record exists and is held by the comune that carried out the transcription: usually the AIRE comune of the Italian spouse, or their Italian comune of last residence or origin. The consulate does not hold it: the consulate forwards the record to the comune, which enters it in its own registers.

If the marriage was never transcribed, there is no Italian record to request. In that case you don’t need a certificate: you need to start the transcription process, which is done through the consulate responsible for the place where you married.

The same applies to religious marriages celebrated in church (matrimonio concordatario): they have civil effect only if transcribed in the comune’s civil status register. If the transcription has taken place, we request the record in the normal way.

Certificate, extract or full copy: which Italian marriage record to request

The four documents have similar names but different contents. With marriage the difference matters more than elsewhere, because only some of them show the matrimonial property regime and the annotations of legal separation or divorce — which are precisely the details the document is usually requested for.

Marriage certificate

The short version. It sets out the names of both spouses, the date and comune where the marriage took place, and the registration details of the record. It does not show the matrimonial property regime and does not include annotations of separation or divorce.

Suitable for: routine administrative matters, enrolments, insurance applications, and any case where you simply need to prove that the marriage exists.

Extract of the marriage record (estratto per riassunto)

It contains everything set out in the certificate, plus the details drawn from the original record: the matrimonial property regime chosen by the spouses — community of property or separation of property — and all marginal annotations: legal separation, divorce, cessation of civil effects, change of property regime, and subsequent transcriptions.

This is the document required in the vast majority of cases: consular applications, divorces, inheritance, banking and property matters, family reunification, and citizenship through marriage.

If you have simply been asked for “the marriage record”, in almost every case this is the one.

International extract (multilingual)

The extract issued on the multilingual form provided for by the Vienna Convention of 1976. Because it is already drawn up in several languages, it does not require a sworn translation in signatory countries: it removes both the cost and the delay of a translation.

One caveat: the international form is concise and does not always show all marginal annotations. If you need proof of a divorce or of the matrimonial property regime, check with the receiving authority that the international extract will be enough. If you’re unsure, ask us before ordering.

Full copy of the marriage record (copia integrale)

A complete reproduction of the record as written in the civil status register: the full text, the witnesses’ details, the officiant, the reference to the marriage banns, and all subsequent annotations and transcriptions. This is what is known in Brazil as a certidão em inteiro teor and in the United States as a long form.

It is the most complete document, but it is not what is needed in most cases. It is requested in specific situations: legal proceedings, contested divorce cases, verification of corrections or inconsistent annotations, genealogical research, and cases where a lawyer or a judge specifically asks for it.

Italian marriage record for citizenship through marriage

Anyone applying for Italian citizenship as the spouse of an Italian citizen — known as citizenship jure matrimonii — must submit the Italian marriage record.

The document normally required is the extract of the marriage record (estratto per riassunto), with an apostille and a sworn translation where the country requires it. The record must already have been transcribed in an Italian comune: if the marriage took place abroad and was never transcribed, the transcription is the first step to take, before the application itself.

The marriage record is also needed in many citizenship by descent applications, where the chain of ancestors has to be reconstructed: in those cases the marriage record of the Italian ancestor may be required, often held in older municipal archives.

Requirements, timeframes and documentation for citizenship applications depend on the consulate concerned and change over time: for those, contact the consulate or a specialist lawyer. We take care of the documents.

Who can request an Italian marriage record

The rules vary depending on the document.

The marriage certificate can be requested by anyone who knows the spouses’ details and the particulars of the marriage. You do not have to be one of the two spouses.

The extract, the international extract and the full record copy follow stricter rules: they can be requested by the spouses, or by someone who can demonstrate a legitimate reason — an heir in an inheritance, a party to legal proceedings, or a descendant in a citizenship application.

One point specific to marriage: information about the matrimonial property regime and annotations of separation or divorce are sensitive data, and some comuni apply stricter checks on who requests them. If you are not one of the spouses, tell us the reason for your request and we’ll let you know straight away whether it can be obtained.

In all cases, in order to act on your behalf with the comune we need a signed authorisation form together with a copy of an identity document. It does not have to be an Italian document: your passport or the identity card of your country of residence is fine. The authorisation can be signed from your phone: no printer, no notary, no certification required.

Apostille and sworn translation of an Italian marriage record

The document issued by the comune is written in Italian and is fully valid in Italy. To use it abroad, two further steps may be required, depending on the country and the receiving authority.

Apostille. The legalisation affixed by the Prefecture (Prefettura) that makes the document valid in countries party to the Hague Convention of 1961. It can only be affixed to the original paper document and requires coordination between the comune and the Prefecture. We take care of this.

Sworn translation. A translation certified at Court by a registered translator, accompanied by a record of the sworn statement. Required when the receiving authority wants the document in the local language. In divorce cases and legal proceedings it is almost always mandatory.

International extract. In countries party to the Vienna Convention, the multilingual form replaces the translation. Do check, however, that it shows the annotations you need: if you require proof of a divorce or of the property regime, in some cases the ordinary extract with a translation is the better choice.

Pay attention to the order of the steps. The apostille and the translation both require the original paper document and extend timeframes compared with simply obtaining the certificate. If you have a court deadline, tell us before you order.

Historical marriage records and municipal archives

We also request marriage records going a long way back, including those held in the historical archives of Italian comuni. These come up frequently in genealogical research and in citizenship by descent applications, where the ancestor’s marriage record is used to reconstruct the family line and to connect the birth records of subsequent generations.

Older records require a manual search through the registers: they carry a surcharge, shown in the order form, and take longer than average. One useful detail in the search is the date of the marriage banns (pubblicazioni di matrimonio), which in historical registers precedes the record itself and is sometimes the only available reference.

We married abroad: does an Italian marriage record exist?

Only if the marriage was transcribed in Italy. In that case the record is held by the comune that carried out the transcription, usually the AIRE comune. If the transcription never took place, there is no Italian record: the transcription has to be started first, through the consulate.

I don't know which comune our marriage was transcribed to. Can you find it?

We married in church. Is a religious marriage registered?

A religious marriage (matrimonio concordatario) has civil effect only if it has been transcribed in the comune's civil status register. If the transcription has taken place, we request the record in the normal way. If you're not sure, we'll check for you.

Does the document show whether we are in community or separation of property?

Yes, but only the extract (estratto per riassunto) and the full record copy. The standard certificate does not show the matrimonial property regime. For banking, mortgage or property transactions in Italy you will therefore need the extract.

I need the marriage record for a divorce abroad. Which one should I order?

The extract, almost always with an apostille and a sworn translation. In legal proceedings a certified translation is normally mandatory: check with your lawyer which format the court requires.

We are already divorced: does the divorce appear on the document?

Yes, if it has been annotated in the margin of the marriage record. The annotation appears on the extract and on the full record copy, but not on the standard certificate. If the divorce was granted abroad, it only appears if it has been transcribed in Italy.

I need it for citizenship through marriage. Extract or full copy?

In the vast majority of cases the extract, with an apostille and a sworn translation. The full record copy is requested only in exceptional situations. If you have the consulate's checklist, send it to us and we'll tell you what to order.

Can I request my parents' or grandparents' marriage record?

The certificate, yes. The extract and the full record copy require a documented legitimate reason: an inheritance, a citizenship by descent application, or legal proceedings. Tell us the reason and we'll check whether it's possible.

One of the spouses is not an Italian citizen. Is that a problem?

No. What matters is that the marriage is registered or transcribed in an Italian comune. The citizenship of the spouses has no bearing on the request for the document.

Do I need SPID or an Italian digital identity?

No. You don't need SPID, an Italian electronic ID card or any account on Italian public administration portals. We handle the procedure with the comune on the basis of your authorisation form.

I don't have an Italian identity document. Is that a problem?

No. For the authorisation form, your passport or the identity document of your country of residence is fine.

Can I request the document if I'm not registered with AIRE?

Yes. AIRE registration concerns your relationship with the consulate, not the request to the comune. We deal directly with the civil status office that holds the record.

Do I need an apostille?

It depends on the destination country and on the receiving authority. It is needed in countries party to the Hague Convention where the authority requires a legalised document. Tell us the country and the intended use and we'll let you know whether it's necessary.

Does the marriage record expire?

The record itself does not expire. Many authorities, however, only accept certificates issued within the last three or six months. With marriage this requirement is more common than elsewhere, because the document has to reflect up-to-date annotations: always check with the receiving authority.

How long does it really take?

15 working days as standard, 7 for the express option, from receipt of the signed authorisation form. Historical records, apostilles and translations require additional time. Timeframes depend on the comune and cannot be guaranteed.
