DEFINITIONS<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For the purposes of these General Terms and Conditions, the following terms have the meanings set out below:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Provider: <\/strong>Claudio Arena (Italian VAT no. 03876350830), owner and operator of the clickcertificati.com platform, who provides the Services on behalf of the Client.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Client: <\/strong>any natural or legal person who accesses the Platform and purchases one or more Services, whether acting as a consumer or as a business.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Consumer: <\/strong>a Client who is a natural person acting for purposes outside their trade, business, craft or profession, pursuant to Article 3 of Italian Legislative Decree 206\/2005 (the Italian Consumer Code).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Basic Service: <\/strong>the intermediation activity by which the Provider requests, on behalf of the Client, a document from the relevant comune, registry office, State Archive or parish archive, and then delivers it to the Client. The Basic Service covers three categories: standard certificates, historical records and baptism certificates.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Standard Certificate: <\/strong>a civil or vital record (residence, family status, birth, marriage, death, citizenship, etc.) relating to recent records, issued by the relevant comune.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Historical Record: <\/strong>a civil or vital record more than one hundred years old, held by the relevant comune, the State Archive or another archival institution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Baptism Certificate: <\/strong>an ecclesiastical document held by the relevant parish archive, requested in cases where the civil registration of the birth is not available, in particular for periods preceding the establishment of civil status registers in Italy (before 1872).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Additional Service \u2014 Apostille: <\/strong>an optional add-on that the Client may select when placing an Order, consisting of obtaining the Apostille under the Hague Convention of 5 October 1961 on the requested document, in order to make it valid in countries party to the Convention without the need for further consular legalisation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Additional Service \u2014 Sworn Translation: <\/strong>an optional add-on that the Client may select when placing an Order, consisting of the translation of the document by a translator entered on the register of expert witnesses of the competent Court, followed by certification by means of a sworn statement before the Court Clerk.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Municipal Fees: <\/strong>any costs charged directly by the comune or archival institution for the issue of the document, separate from and additional to the price of the Basic Service. These arise mainly in connection with Historical Records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Third-Party Professional: <\/strong>a sworn translator or other professional external to the Provider, appointed to carry out Additional Services requiring certified specialist expertise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Platform: <\/strong>the website www.clickcertificati.com and all of its content, functionality and Services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Order: <\/strong>the request formally submitted by the Client through the Platform for the purchase of a Basic Service, with or without Additional Services.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. INTRODUCTION AND ACCEPTANCE<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These General Terms and Conditions govern the contractual relationship between the Provider and the Client in respect of all Services available for purchase through the Platform. Submitting an Order constitutes full and unreserved acceptance of these General Terms and Conditions, of the specific terms applicable to the requested Service and of the Privacy Policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Provider reserves the right to amend these General Terms and Conditions at any time. Amendments take effect from the date they are published on the website; continued use of the Platform after publication constitutes acceptance of the new terms.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3. SUBJECT MATTER OF THE CONTRACT<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Provider supplies, on behalf of the Client, a Basic Service of intermediation for obtaining official documents. The Client may combine the Basic Service with one or more Additional Services from those available at the time of the Order. The Provider is not a public authority, does not issue documents itself and does not act as a substitute for public administrations or for the Third-Party Professionals appointed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each contract between the parties consists of the following documents, in order of precedence: a) the General Terms and Conditions; b) the request form; c) the Service description page; d) the Privacy Policy.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. FORMATION OF THE CONTRACT<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The contract is formed when the Provider receives confirmation of the Order and the corresponding payment. The Client receives a confirmation email at the address provided at the time of purchase. Where payment is made by bank transfer, the contract is deemed concluded when the funds are actually credited.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4.1 Refusal or cancellation of an Order<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Provider may refuse or cancel an Order \u2014 having first notified the Client \u2014 in the following cases: supervening impossibility of performance due to force majeure; the Client not meeting the requirements set by law; publication of an incorrect or manifestly nominal price; reasonable suspicion of unlawful use of the Service. In the event of cancellation, the Client receives a full refund within 14 working days.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">5. BASIC SERVICE<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Basic Service consists of intermediation for obtaining an official document on behalf of the Client. The Client must always provide the identifying details required for the request (first name, last name, date and place of birth of the individual concerned, and any other information requested in the order form). The three categories of Basic Service are governed by the paragraphs below.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5.1 Standard certificates<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">These include current civil and vital records (residence, family status, birth, marriage, death, citizenship, etc.) issued by Italian comuni. Indicative processing times are as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Standard service: within 15 working days of payment confirmation.<\/li>\n\n\n\n<li>Express service: within 7 working days of payment confirmation (subject to a surcharge).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These timeframes are indicative and do not constitute an essential term of the contract. The Provider is not liable for delays caused by municipal offices, strikes or other events beyond its control. If the express deadline is not met for reasons attributable to the Provider, the surcharge will be refunded.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5.2 Historical records<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">These include civil and vital records more than one hundred years old, held by the relevant comune or by the State Archive. The Client must provide the essential details of the individual concerned (first name, last name, approximate year and place of birth) so that the document can be located.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Historical Records are not subject to the standard processing times applicable to Standard Certificates. Timeframes vary depending on the archive holding the record, its access procedures and the response times of the institution concerned. An indicative estimate is provided to the Client at the time of the Order.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5.2.1 Municipal Fees for Historical Records<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">For the issue of Historical Records, some comuni or State Archives may require the payment of Municipal Fees, the amount of which varies from one institution to another and cannot be determined in advance by the Provider. These costs are particularly common for historical birth records and may reach significant amounts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The procedure is as follows: if, during processing, the competent institution requires the payment of Municipal Fees, the Provider will promptly notify the Client by email, indicating the exact amount and the payment details supplied by that institution. Processing is suspended until the Client confirms payment. The Client is free either to proceed with payment or to withdraw the request.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Municipal Fees are a cost imposed by the competent public authority and are entirely separate from the price of the Provider&#8217;s Service. The Provider derives no margin from these sums and accepts no liability in respect of them. If the Client declines to pay the Municipal Fees, the Basic Service is deemed incapable of performance and the provisions of Section 5.4 on unsuccessful outcomes apply.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5.3 Baptism certificates<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">These include ecclesiastical documents held in parish archives, requested in cases where the civil registration of the birth is not available \u2014 in particular for periods before 1872. The Client provides the identifying details of the individual concerned (first name, last name, relevant parish where known, approximate year of birth).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Processing times depend on the availability and access procedures of the relevant parish archive and cannot be standardised. An indicative estimate is provided to the Client at the time of the Order. The Provider is not liable for delays or inability to access records attributable to the parish.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Baptism certificates are not civil status records, and their legal value depends on the law of the country or the requirements of the institution requesting them. It is the Client&#8217;s responsibility to verify that the document is suitable for their intended purpose before placing an Order.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5.4 Unsuccessful outcome<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Where the document cannot be located or cannot be issued for reasons beyond the Provider&#8217;s control (gaps in the registers, refusal by the institution, non-existent document), the Client will be informed promptly. In such cases no refund of the Basic Service is due, save for the return of any express surcharge where the deadline was not met for reasons attributable to the Provider.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5.5 Supporting documentation<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">For certain types of document, the Provider may ask the Client to supply additional documentation (for example, a copy of an identity document or a signed authorisation form). Processing times are suspended until such documentation is received.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">6. ADDITIONAL SERVICES<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Additional Services are optional add-ons that the Client may select at the time of the Order to combine with the Basic Service. Two Additional Services are available: the Apostille and the Sworn Translation. Both are carried out on the document obtained through the Basic Service and presuppose its successful completion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Additional Services are only initiated once the Basic Service has been completed, that is, once the requested document has been obtained. Where the Basic Service is unsuccessful, the fees for the Additional Services are refunded in full.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6.1 Apostille<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Apostille Additional Service consists of obtaining, on behalf of the Client, the Apostille on the document obtained through the Basic Service. The Apostille is provided for under the Hague Convention of 5 October 1961 and certifies the authenticity of the document for use in countries party to the Convention, without the need for further consular legalisation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Apostille is issued by the competent Prefecture (Prefettura). Issuing times depend on the issuing office and are beyond the Provider&#8217;s control. The apostilled document is delivered to the Client in digital format (scan) and, on request, as a paper original by courier at the Client&#8217;s expense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The Apostille Service applies only to documents intended for countries party to the Hague Convention. For non-signatory countries, consular legalisation is required, which constitutes a separate Service. Clients are advised to verify whether the destination country is a party to the Convention before selecting this Additional Service.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6.2 Sworn Translation<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Sworn Translation Additional Service consists of having the document obtained translated by a Third-Party Professional \u2014 a translator entered on the register of expert witnesses of the competent Court \u2014 and certified by means of a sworn statement before the Court Clerk. A sworn translation has legal value and is required in order to use Italian documents abroad or for specific administrative procedures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Provider coordinates the Service: it receives the document, entrusts it to a suitably qualified Third-Party Professional and returns the certified translation to the Client. The quality and accuracy of the translation are the sole responsibility of the Third-Party Professional, who acts in full professional independence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>A sworn translation has legal value only in the original paper version bearing the translator&#8217;s stamp and signature together with the record of the sworn statement. The digital version (PDF) serves as an informational copy only. The Provider is not liable for errors or inaccuracies in the translation attributable to the Third-Party Professional.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The languages available for the Sworn Translation Service are set out in the Service description pages on the Platform. Processing times vary according to the length and complexity of the document and the language requested; an indicative estimate is provided to the Client at the time of the Order.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">7. DELIVERY<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Once processing is complete, the document is delivered to the Client as follows:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Digital format (PDF): <\/strong>the standard method for all Services. The document is sent to the email address provided at the time of the Order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Original paper format: <\/strong>available on request for Standard Certificates and for apostilled documents. Courier shipping costs are borne by the Client and are indicated before the Order is completed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Sworn Translation: <\/strong>delivered as a paper original, which is the only version with legal value. Shipping is arranged by the Provider by courier, at the Client&#8217;s expense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Client receives an email notification once the Order is complete. We recommend also checking your spam folder. The Provider is not liable for delays in postal or courier delivery attributable to the carriers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">8. ACCOUNT AND REGISTRATION<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Registration is not required in order to place an Order. The Client may, however, create a personal account by entering a valid email address and a secure password. The account is strictly personal: transferring or sharing login credentials with third parties is prohibited. In the event of unauthorised access or loss of credentials, the Client must notify info@clickcertificati.com immediately.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">8.1 User dashboard<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The account allows the Client to check the status of Orders in progress, access their purchase history and manage their billing and contact details.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">8.2 Account deletion and GDPR rights<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">To request deletion of an account, simply send a request to info@clickcertificati.com. Within 48 working hours the data will be removed, with the exception of data whose retention is required by law. Under EU Regulation 2016\/679 (GDPR), the Client has the right of access, rectification, erasure, portability, restriction of processing and objection in relation to their personal data.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">9. PRICES AND PAYMENT METHODS<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">All prices shown are exclusive of VAT unless otherwise stated and may be updated without notice. Where an incorrect price is published, the Order will be cancelled and the Client refunded in full. Any Municipal Fees charged by public institutions for Historical Records (Section 5.2.1) are not included in the price of the Service and are notified separately.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">9.1 Card payment (Stripe)<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Client may pay by credit card, debit card or prepaid card through the secure Stripe platform. The Provider does not acquire or store card details.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">9.2 Advance bank transfer<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Where payment is made by bank transfer, processing begins only once the funds have actually been credited. Payment must be received within 5 working days of Order confirmation; after this period the Order will be cancelled automatically. The transfer reference must include the Order number. Bank details are provided in the confirmation email.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">10. RIGHT OF WITHDRAWAL<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A Client who is a Consumer has the right to withdraw from the contract without giving reasons within 14 days of its conclusion, pursuant to Article 52 of the Italian Consumer Code. Withdrawal is exercised by sending written notice to the contact details set out in Section 15.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">10.1 Exclusion of the right of withdrawal<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Pursuant to Article 59(1)(a) of the Italian Consumer Code, the right of withdrawal cannot be exercised where the service has been fully performed before the expiry of the 14-day period, with the Client&#8217;s prior express consent and express acknowledgement of the loss of the right of withdrawal. This consent is obtained at the time the Order is completed.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">10.2 Effects of withdrawal and refunds<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Withdrawal exercised before processing has begun entitles the Client to a full refund within 14 days. If processing has already begun, the Provider will retain an amount proportionate to the work carried out. No refund is granted in the following cases:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>a) the service has been fully completed;<\/li>\n\n\n\n<li>b) the unsuccessful outcome of the Basic Service is the result of incorrect or insufficient information provided by the Client;<\/li>\n\n\n\n<li>c) in the case of Additional Services, the work has already been entrusted to the Third-Party Professional or to the office responsible for the Apostille;<\/li>\n\n\n\n<li>d) the Client has declined to pay the Municipal Fees required by the institution (Section 5.2.1).<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Where the Basic Service is unsuccessful for reasons not attributable to the Client, the fees for the Additional Services are refunded in full.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">10.3 Withdrawal by the Provider<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Provider may withdraw from the contract giving 15 days&#8217; notice by certified email (PEC) or registered letter with return receipt. Withdrawal takes immediate effect in the event of unlawful conduct by the Client or of force majeure.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">11. OBLIGATIONS AND LIMITATIONS OF LIABILITY<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Provider undertakes to perform all Services with professional diligence. Save in cases of wilful misconduct or gross negligence, the Provider is not liable for delays or damages arising from events beyond its control, including: malfunctions of public offices or archives, strikes, natural disasters, interruptions to postal or digital services, and the technical timeframes of the Third-Party Professionals appointed.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">11.1 Client obligations<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Client undertakes to provide accurate, complete and truthful information when placing an Order; to use the documents obtained solely for lawful purposes; and not to transfer, disclose or resell the documents obtained to third parties. The Client is solely responsible for any non-compliant use and undertakes to indemnify the Provider against any claim for damages.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">11.2 Processing of third-party data<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Where the Service concerns the personal data of third parties, the Client declares that they are acting in full compliance with EU Regulation 2016\/679 (GDPR): that they have obtained the consent of the data subject, or that another lawful basis provided for by law applies. The Provider processes such data solely as a data processor and only for the purposes necessary to perform the Service.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">12. INTELLECTUAL PROPERTY<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">All content on the Platform \u2014 text, graphics, logos, interfaces, software and any other element \u2014 is the exclusive property of the Provider or of third parties who have granted permission for its use. Any reproduction, distribution, modification or commercial use without the Provider&#8217;s prior written authorisation is prohibited.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">13. TERMINATION OF THE CONTRACT<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Failure to comply with the obligations set out in these General Terms and Conditions results in immediate termination of the contract and cancellation of all Orders in progress. Termination also operates by operation of law where the information provided by the Client proves to be false, incorrect or misleading, or where the Services are used for unlawful purposes or purposes otherwise prohibited by applicable law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">14. GOVERNING LAW AND JURISDICTION<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This contract is governed by Italian law. For disputes involving Clients who are Consumers, jurisdiction lies with the court of the place of residence or elected domicile of the Consumer, pursuant to Article 66-bis of the Italian Consumer Code. In all other cases, the parties agree that the Court of Messina shall have exclusive jurisdiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The above does not affect any mandatory consumer protection provisions applicable in the Client&#8217;s country of habitual residence.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">14.1 Out-of-court dispute resolution<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The European Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 following the adoption of Regulation (EU) 2024\/3228. Consumers resident in the European Union may consult the list of alternative dispute resolution bodies available in the Member States at: https:\/\/consumer-redress.ec.europa.eu\/dispute-resolution-bodies<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">15.
